ABSTRACT
The democratisation process is ongoing, and political parties play an important role in it. Nigeria’s political parties are no different. However, since the establishment of the Fourth Republic in 1999, Nigerian political parties have demonstrated a relatively low level of internal democracy.
This is notably evident in the ruling People’s Democratic Party (PDP), particularly in the way party primaries are conducted. This study looked at the administration of justice and internal party democracy during the 2007 gubernatorial election primary.
Two research questions about the implementation of the rule of law and the structure of the PDP were raised. Using Marxist theory, it was found that the PDP had an oligarchic structure,
with a few important leaders dictating the party’s policies. Without the intervention of the judiciary, the PDP leadership would have succeeded in undermining justice in Rivers State PDP during the 2007 gubernatorial election primary.
