ABSTRACT
This research study focusses on the discriminations that women in Igboland suffer when it comes to the acquisition and inheritance of property following the death of their spouse or father.
Women would undoubtedly suffer greatly from numerous inequities and prejudice. So, in the case of Ukeje v Ukeje, the Supreme Court ruled that any customary law that states or suggests that a female child cannot inherit her father’s property is not only illegal but also null and invalid.
In an attempt to identify the difficulties of gender discrimination in women’s right to inheritance under Igbo customary law, some factors include non-codification of customary rules, illiteracy, and limiting women’s rights in and out of marriage due to unpleasant customs.
The research aims to discover rules that discriminate against women’s inheritance under Igbo customary law, which the law wishes to eliminate through practical and legal measures.
This will be accomplished through a critical examination of the well-known case of Ukeje v. Ukeje, as well as other legislative enactments and judicial decisions, as well as material gleaned from researchers and authors.
The data indicate that, with recent judicial decisions and our legislation, these unpleasant customs can be completely eliminated in Igboland. To do this, the researcher used doctrinal and method. It relies on both primary and secondary sources to collect information.
As a result, the authors advocate for the provision of free legal services and guidance on property rights to women in Anambra State in order for them to safeguard and enforce their property rights.
This might be accomplished by focussing on critical locations such as churches, markets, and rural communities with a high percentage of uneducated women.
There is also a need to improve and enforce our laws protecting women’s inheritance rights. Recommendations are presented, and if followed, will assist women break free from the chains of property rights denial.
