Chapter One: Introduction 1.1 Background of the Study

The globe has become a global village, with telecommunications playing a critical role in the globalisation process[1]. However, it is widely acknowledged that the telecommunications industry plays an important part in this process.

This is clearly why the development process in this critical industry has been remarkable throughout the years around the world. Indeed, this is why the rising trend in socioeconomic progress shows a high premium being placed on

Nations, organisations, and homes use information and communication technology (ICT2). Unlike in the past, governments now regard telecommunications services as so critical to national interest and economic progress that they were placed directly under their control in most nations until relatively recently, when deregulation and competition were implemented3.

Telecommunications[2] is the merging of audio-visual and telephone networks with computer networks, and the technology covers a wide range of activities, from office data processing to remote control and monitoring of production robots12.

It also includes enabling infrastructures such as fibre optic cables, which transport voice, data, and video communications[3]. The creation of the internet, a content distribution network made up of a global system of interconnected computer networks that exchange data, is a significant result of telecommunications convergence.

The technology is made up of millions of private and public academic, commercial, and government networks on a local and worldwide scale, which allows information distribution and sharing while also making various other forms of non-physical connection a reality.

Because of their numerous applications, telecommunications are invaluable tools for socioeconomic development, making the legal and regulatory environment for their use in developing nations important.

Among other effects, telecommunications has caused significant changes in business practices in terms of banking transactions and, to a lesser extent, the buying and selling of goods and services, due to the medium’s ability to promote trade and commerce by providing greater access to prospective customers from anywhere in the world for products and services.

Telecommunications has so altered the corporate world, including the banking, commerce, and entertainment industries, making them more efficient and less constrained by time, place, distance, and expenses.

Telecommunications has the potential to alleviate poverty through websites that promote local items in worldwide marketplaces and provide access to market information for competitive rates on locally made crafts, apparel, and farm produce[4].

The technology also allows for the exploitation of foreign markets for cultural products, which are growing in tandem with the African Diaspora’s desire for access to local food, clothing, music, films, and other aspects of their cultural identity and heritage.

In contrast, the technology has been accompanied by the introduction of new dimensions of crime by people who, rather than embracing the potential given by ICT in acceptable ways for beneficial activities, instead do so for dubious or outright fraudulent acts.

Thus, cybercrimes[5] such as child pornography, fraudulent electronic financial transfers, and unauthorised access to computer systems have grown common.

Tackling the problem of cybercrime and the associated image nightmare for Nigeria presents legal and policy challenges, resulting in efforts to extend the laws to suit the new challenges.
